What We Do

Joe Wilson is a founding partner of Curiale Wilson LLP. His practice is focused on employment defense litigation, including misclassification, wage and hour claims, discrimination, wrongful termination, harassment, and California Private Attorney General Act (PAGA) actions. In his practice, Joe has successfully represented clients in both state and federal courts, before the California Labor commissioner, the National Labor Relations Board, and in arbitration. Joe is licensed to practice before all the Courts of the State of California, the United States District Courts for the Northern and Central Districts, and the Ninth Circuit Court of Appeals.

Recent Representative Matters:

Lead trial counsel for employer in PAGA representative action.

Lead trial counsel for large manufacturing company sued by a former manager alleging age discrimination, disability discrimination, CFRA retaliation, FEHA retaliation, failure to provide reasonable accommodations, and failure to engage in interactive process. Obtained unanimous defense verdict at trial.

Lead trial counsel for large food manufacturer sued by former employee for alleged FMLA violations and disability discrimination. Litigating issues involving joint-employer relationship with a third party temp agency and was able to obtain settlement where client paid nothing and claims against it were dismissed with prejudice.

Lead trial counsel for large furniture retail company sued by former employee for alleged FMLA retaliation. Successfully compelled arbitration where issue involved employee's ability to read and understand English. Aggressive litigation lead to settlement on eve of arbitration for small nuisance value.

Lead trial counsel for large technology company alleging trade secret violations against former employee who joined competitor. Successfully obtained temporary restraining order and preliminary injunction, leading to favorable settlement.

Lead trial counsel for large technology company sued by former employee for alleged breach of contract. Aggressive litigation and countersuit led to a full dismissal with prejudice of claims against my client and also obtained payment for countersuit.

Second chair in unfair labor practice trial before NLRB and defended client on NLRB's appeal of verdict. Involved in several collective bargaining negotiations with same client and multiple unions.
